1. Acceptance of Terms

By accessing or using the ChatPlay platform, you declare that you have read, understood and accepted the following documents:

• Privacy Policy
• GDPR Notice
• Cookie Policy

If you do not accept these terms, you cannot use the platform.

2. Service Description

ChatPlay is an interactive viewer gaming platform for Twitch and Kick streamers. The platform offers the following features:

• Twitch/Kick OAuth integration
• Interactive viewer games (Guess It, Draw & Guess, Find the City, Flag Game, etc.)
• Chat integration
• Real-time game management
• Moderator controls

Platform features may change, be added or removed over time.

3. User Account

3.1. Account Creation

You need to log in with your Twitch or Kick account to use the platform. By creating an account, you:

• Are at least 13 years old (13-18 years old with parental/guardian consent)
• Provide accurate and current information
• Are responsible for the security of your account
• Will not share your account with others

3.2. Account Security

You are responsible for the security of your account. If you notice unauthorized access, you should immediately notify us. You are responsible for all activities that occur in your account.

3.3. Account Suspension and Closure

Your account may be suspended or closed in the following situations:

• Violating these terms
• Threatening platform security
• Providing misleading or false information
• Engaging in illegal activities
• Harming other users

Our account closure decision is final and binding.

4. User Responsibilities

You must comply with the following rules while using the platform:

Permitted Behaviors:
• Using the platform as intended
• Being respectful to other users
• Using content for legal purposes
• Reporting issues

Prohibited Behaviors:
• Threatening platform security
• Using spam, bots or automated systems
• Unauthorized access to other users' accounts
• Spreading malware
• Violating intellectual property rights
• Sharing misleading or false information
• Reverse engineering the platform
• Hate speech, harassment or threats
• Sharing illegal content
• Using the platform for illegal purposes

5. Content and Intellectual Property

5.1. Platform Content

All content, design, logos, graphics, code and materials on the platform are owned by ChatPlay or its licensors and are protected by copyright laws. Unauthorized use, copying, distribution or modification is prohibited.

5.2. User Content

Content you create on the platform (drawings, game sessions, etc.) is your property. However, you grant ChatPlay the following rights:

• Display your content on the platform
• Store and process your content
• Use for platform improvements
• Conduct statistical analysis

You are responsible for ensuring that your content complies with laws and does not violate third party rights.

5.3. Third Party Content

The platform is integrated with third-party services such as Twitch and Kick. The content and terms of use of these services are the responsibility of the relevant platforms.

6. Service Availability

ChatPlay provides the platform "as is" and "as available". We do not guarantee:

• Uninterrupted or error-free service
• That all errors will be corrected
• That platform security is 100%
• Availability of third party services

The platform may be temporarily unavailable due to maintenance, updates or technical issues. We may change, remove features or terminate service without prior notice.

7. Privacy and Data Protection

For detailed information about the processing of your personal data:

You can review the documents. By using the platform, you accept that your personal data will be processed within the scope of these documents.

8. Limitation of Liability

To the extent permitted by law, ChatPlay is not responsible for:

• Direct or indirect damages resulting from platform use
• Data loss or corruption
• Loss of business, revenue or profit
• Problems caused by third party services
• Problems arising from user content
• Unauthorized access or data breaches
• Platform interruption

Our total liability is limited to the amount you paid to the platform in the last 12 months (100 TL for free services).

9. Indemnification

By using the platform, you agree to protect and indemnify ChatPlay, its employees, partners and licensors against claims, damages and expenses (including attorney fees) arising from the following situations:

• Your violation of these terms
• Your violation of laws or third party rights
• Your misuse of the platform
• Content you upload or share

10. Third Party Links

The platform may contain links to third party websites or services:

• Twitch (www.twitch.tv)
• Kick (www.kick.com)
• Google Analytics

We are not responsible for the content, privacy policies or practices of these third party sites. We recommend that you review the relevant terms and policies before using these sites.

11. Changes to Terms

We reserve the right to change these Terms of Service at any time. When significant changes are made:

• The "Last Updated" date on this page is changed
• Email notification may be sent
• Announcement may be displayed on the platform

Changes take effect from the moment they are published. By continuing to use the platform, you are deemed to have accepted the current terms.

12. Termination of Service

You can terminate your account in the following situations:

• Anytime, without giving a reason
• Delete account from account settings

ChatPlay may terminate your account in the following situations:

• Your violation of these terms
• Legal requirements
• Platform security reasons
• Being inactive for a long time (2 years)

When an account is terminated, your data is processed within the scope of GDPR Notice.

13. Applicable Law and Jurisdiction

These Terms of Service are subject to the laws of the Republic of Turkey and are interpreted according to Turkish laws. Istanbul Courts and Enforcement Offices are authorized for disputes arising from the use of the platform.

However, you can apply to the Personal Data Protection Authority for your rights under KVKK/GDPR.

14. General Provisions

14.1. Entire Agreement

These terms constitute the complete agreement between the parties and supersede all previous agreements.

14.2. Waiver

Our waiver of any right does not mean that we have waived that or other rights.

14.3. Severability

If any provision of these terms is deemed invalid, the other provisions remain valid.

14.4. Assignment

You cannot transfer these terms or your account to another person. ChatPlay may transfer these terms without prior notice.

14.5. Force Majeure

We cannot be held responsible for our failure to fulfill our obligations due to events beyond our control (natural disasters, war, internet outages, etc.).
